A Federal Judge Finally Cites the Constitution in Hopeful Decision

9/15/2020– A Federal District Court Judge overturns Covid-19 lockdown measures in Pennsylvania on the basis it is unconstitutional. The opinion directly cites a violation of the 1st and 14th Amendment of the Federal Constitution. Judge William Stickman IV is a Trump appointee to the Federal Court. “The Constitution cannot accept the concept of a ‘new normal’ where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,”.

“Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by Defendants crossed those lines. It is the duty of the Court to declare those actions unconstitutional.”

“Broad population-wide lockdowns are such a dramatic inversion of the concept of liberty in a free society as to be nearly presumptively unconstitutional unless the government can truly demonstrate that they burden no liberty than is reasonably necessary,”

“There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment,”

“What was initially billed as a temporary measure to ‘flatten the curve’ and protect hospital capacity have become open-ended and ongoing restrictions aimed at a very different end — stopping the spread of an infectious disease and preventing new cases from arising,”

“After six months, there is no plan to return to a situation where there are no restrictions imposed upon the people of the Commonwealth,
