Keeping harping this message. I believe they are just waiting to, as much as possible, to close the window for an appeal before the election. If the RNC is on the ball they will preemptively file a Petition for a Writ of Prohibition.
Speaking of this writ, I cannot understand why President Trump’s lawyers did not file a Petition to prevent the trial in N.Y. File in Federal District Court, appeal to the Circuit Court of Appeals, and then Petition a Writ of Certiorari in the Supreme Court. I cannot figure this out. Comments anyone?

2) The Constitution assigns the management of voting to the states
Note that I didn’t add that “executive orders cannot override or negate the Constitution or current legislation” – which is true, but which the Executive Branch has nevertheless been getting away with doing for some time, e.g. DACA, open borders, etc.
